Selection of most favourable bids in tender procedures raises concerns due to inappropriate application of bidevaluation criteria and elements. The most concerning problem in public procurement procedures was recorded in regard to criteria used for the selection of most favourable bid.

Low competition on tender procedures gains in intensity. 35% of public procurements monitored were marked by one or no bid submitted by companies. Moreover, together with the tender procedures where only 2 bids have been submitted, the share of public procurements marked by low competition accounts for as high as 52.5% of total public procurements procedures monitored. When compared to findings from the previous monitoring period, this period was marked by an increasing low interest on the part of companies to participate in tender procedures, which ultimately leads to lower competition.

High number of annulled tender procedures remains a bottleneck in the public procurement system. In the third quarter of 2011, a total of 444 decisions were taken to annul tender procedures, which accounts for 26.57% of the total number of public procurement procedures implemented in the same period. Analyses show that most frequently referred law-stipulated ground for public procurement annulment (indicated in as high as 51.03% of cases) was the failure to obtain any bids or failure to obtain an acceptable bid.
