More than 170 representatives of municipalities and local public enterprises from Bitola, Kichevo, Kumanovo, Negotino, Strumica, Tetovo, Chair and Shtip participated in a series of 8 trainings held from May to October this year, which should help the municipal administration and of employees in local public enterprises to introduce an integrity system, to increase transparency, as well as assess the risks of corruption in public procurement and reduce them.

The Index of Rationality no.19 is developed for the following types of products: - air purifiers; - laptops; and - industrial salt. Development of individual indices for these products covered a total of 21 national and local institutions that have organized public procurements for these types of goods in the course of 2020 and 2021.

Preventing Corruption in Public Procurement: What can the contracting authorities do? This policy brief is focused on addressing corruption and conflict of interests in public procurement at institutional level, i.e. what can and should be done in this regard.

The project includes activities to reduce corruption and misuse of public funds of local governments by increasing the transparency, accountability and integrity of local institutions and implementation of measures provided in the National Strategy for Prevention of Corruption and Conflict of Interest 2021-2025. The project is implemented with financial support from the Kingdom of the Netherlands.

The project strengthens the integrity and reduces the risks of corruption in public procurement in enterprises established by the central government and local self-government by identifying weaknesses and implementing measures to overcome them. In 2021, active transparency of line ministries, the government and municipalities is calculated at 63% (from maximum possible 100%) and according to the categorization of compliance rates falls within the category of “good” active transparency. In 2021, active transparency has been improved by 5 percentage points (from 58% to 63%).

The proposed measures are developed on the basis of in-depth research of corruption risks, systematized in the research paper “Mapping Corruption Risks in Public Procurements of Enterprises Owned by the Government and Municipalities” and individual screening of 37 state-owned enterprises founded by the Government, the City of Skopje and Municipalities of Gostivar, Kavadarci and Struga, which provides an overview of key parameters that reflect the manner in which they implement public procurements, as well as their human resource capacity and internal policies. Weaknesses noted in all previously conducted research papers and analyses have confirmed the need to enhance integrity and reduce corruption risks at public enterprises and joint stock companies.Recommendations presented in this document are drafted as part of the project “Towards Accountable Enterprises”, implemented by the Center for Civil Communications with financial support from the Embassy of the Kingdom of the Netherlands in Skopje in the period 2019-2021, and aimed at establishing sustainable mechanisms to advance implementation of public procurements and to strengthen integrity in the process of public spending under tender procedures organized by state-owned enterprises founded by the Government, the City of Skopje and Municipalities of Gostivar, Kavadarci and Struga.In February 2021, the Center for Civil Communications presented the Government of the Republic of North Macedonia with portion of proposed measures, as presented in this document, as contribution in the process of drafting the Government’s Action Plan to Fight Corruption.

Standards that are used to assess transparency and accountability demonstrated by state-owned enterprises were selected on the basis of analysis of relevant legislation and international standards. Hence, dominant share of selected standards are legally binding for all state-owned enterprises, while small share of them are standards that are considered good practices.

Although procurements implemented under negotiation procedure without previous announcement of call for bids are subject to obtaining previous opinion from the Bureau of Public Procurements, they can also be implemented directly, i.e. without obtained opinion, in compliance with Article 55, paragraph (6), which stipulates that: “As an exemption from paragraph (5) of this article, the contacting authority shall not be obliged to obtain a previous opinion before implementation of negotiation procedure without previous announcement of call for bids, pursuant to paragraph (1), item d) of this article when the safety, life and health of people are directly threatened”.

Today, 6 October 2020, the Center for Civil Communications (CCC) releases its research paper “Mapping Corruption Risks in Public Procurements of Enterprises Owned by the Government and Municipalities”. Corruption risks were mapped as part of in-depth monitoring conducted on tender procedures of 37 joint stock companies and enterprises founded by the Government, the City of Skopje and Municipalities of Kavadarci, Gostivar and Struga. In 2029, these enterprises have signed public procurement contracts in the value of 247 million EUR, accounting for 27% of all public procurements in the country. Key findings from the analysis: Corruption risks detected are manifested as frequent and significant changes to public procurement plans, but also poor implementation rate of these plans. In the case of 16 from 37 analysed enterprises, implementation rate of their public procurement plans is below 50%. The highest implementation rate of 96% is noted with JSC MIA, while the lowest rate of only 1% is noted with JSC Water Economy. Concentration of public procurements with particular company, as one of the most relevant indicators of corruption risks, is a problem noted with large portion of analysed enterprises and joint stock companies. In the case of almost one third of them, concentration of public procurements with one company exceeds 40%. The highest value share for single company is observed with JSC Power Plants, while the highest share for public procurements is observed with JSC Water Economy. In 2020, average active transparency of all 98 ranked institutions is calculated at 58.2% (from maximum possible 100%) and according to the categorization of compliance rates falls within the category of “average”. Active transparency index 2018 The general degree of active transparency in Macedonia in 2018 remained low. The percentage of fulfillment of the obligations for active publication of information in all 97 participating institutions was 43.5% (out of 100%).
